Terms of Service

1. Acceptance of Terms

By accessing or using MythFoundry Studio ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

MythFoundry Studio is operated by Sean Alan LaViscount ("S.A. LaViscount," "we," "us," or "our").

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age, OR
  • Be at least 16 years of age with verifiable parental or guardian consent
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable laws

By creating an account, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Platform Services

MythFoundry Studio provides:

  • Interactive mythology experiences through MOMMA (Mythic Operational Memory Matrix Agent)
  • Story creation and saving capabilities
  • Character creation within the mythology framework
  • Access to tiered content (Free, Member, Creator, Pro Creator)
  • Creator Arena competitions with royalty opportunities

5. Subscription Tiers & Payments

We offer the following access tiers:

  • Free Access: Limited content and features
  • Member Pass ($5): Expanded access and 1 character slot
  • Creator Pass ($29): Full content access and 5 character slots
  • Pro Creator Pass ($99): Complete access, unlimited characters, priority features

All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. All sales are final unless otherwise required by law.

6. User Content

You retain ownership of content you create on the Platform ("User Content"), subject to the following:

  • You grant us a non-exclusive license to display, store, and process your User Content
  • You are responsible for ensuring your content does not infringe third-party rights
  • We may remove content that violates these Terms or applicable laws
  • Content submitted to the Creator Arena is subject to the Creator Licensing Agreement

7. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Platform
  • Harass, abuse, or harm other users
  • Use the Platform for illegal activities
  • Scrape or collect data without permission
  • Impersonate others or misrepresent your affiliation

8. Intellectual Property

All Platform content, including but not limited to the Genesis Engine, MYTHOS//ENGINE, Earth 0.1 mythologies, MOMMA system, graphics, logos, and software, are owned by S.A. LaViscount and protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from Platform content without explicit written permission.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE, AND WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, S.A. LAVISCOUNT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless S.A. LaViscount from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the Platform.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws provisions.

Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If unresolved after 30 days, disputes will be submitted to binding arbitration administered by JAMS in Los Angeles County, California. The arbitration will be conducted in English under JAMS Streamlined Arbitration Rules, and the decision will be final and enforceable in any court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or Platform notification.
